The Candy Store Cup is an invitational regatta set in the Corinthian spirit. Yachts that participate do so at their own risk. The regatta is open to yachts over 90’ LOA, unless invited under the ‘Grandfather Clause.’ The 2017 regatta will offer a ‘Corinthian Spirit’ class (NOR Part 2 / 6.5). Safe sailing is the highest priority of the event organizer; therefore, an invitation is extended to those yachts whose owners, Captains, crews and guests will participate and endeavor to make this a safe and fun event. The fleet will be divided into classes at the sole discretion of the Race Committee. Part 1 of this notice deals with general administrative information and Part 2 with the rules and conditions of the regatta.
The Candy Store Cup will be headquartered at Newport Shipyard.
PART 1: GENERAL ADMINISTRATIVE INFORMATION

3. RACE OFFICE
The Candy Store Cup race office will be located under the marquee at the Newport Shipyard in Newport, Rhode Island.
4. CAPTAIN’S BRIEFING
The Captain’s Briefing will be held at 1700 on Wednesday, July 26 at Newport Shipyard. Each yacht shall be represented by her Captain, designated RRS-Safety Afterguard Member and Racing Tactician (if applicable).
Dockage in Newport will be at Newport Shipyard, the official site for the event. Dockage will be assigned on a first come, first served basis. For more information on dockage contact:

6. NEWPORT ACCOMMODATIONS

7. MEDIA RIGHTS
Entrants and crewmembers give right and permission to use their name, voice, image, likeness, as well as representation of their yachts in any media (television, print, video footage, and internet media) for the purpose of press information, reporting, promoting and disseminating information. For all media, the yacht owner’s name shall not be published without obtaining permission from the Organizer, or the owner directly. Otherwise, the owner shall be referred to as “the owner of Yacht Name.”
8.1 It is a requirement of entry to this regatta that each yacht shall be insured by a reputable insurance company for physical loss of, or damage to, the yacht up to current market value of the yacht and all its equipment onboard and also insured for Third Party Liability risks up to $5,000,000 (or the equivalent in other currencies) for the period of the regatta set out in the schedule.
8.2 The captain shall ensure that a Certificate(s) of Insurance (which must be in English), reflecting the above required insurance requirements, is carried on board the yacht at all times during the regatta. The yacht’s insurer(s) shall be notified of the yacht’s participation in the regatta and a copy of the regatta’s Notice of Race and Sailing Instructions (including the Candy Store Cup Disclaimer of Liability Form) shall be provided to the yacht’s insurer(s).

PART 2: RACING RULES & CONDITIONS
The 2017 Candy Store Cup is organized by Newport Shipyard and Bannister’s Wharf.
The Candy Store Cup will be governed by the following:
a) The rules as defined in The Racing Rules of Sailing (RRS);
b) Appendix SY to the RRS (Exhibit 2);
c) The ORC Superyacht Rule (ORCsy)
d) Adjustments to the ORCsy for new 'Corinthian Spirit' class - www.orc.org
e) The safety requirements designated by the yacht’s Flag State, Classification Society and/or code of compliance;
e) Any applicable local maritime authority rules and regulations.
Note: RRS 55 (trash disposal) will be in effect. Disposable sail stops for spinnakers are not allowed.
3. SAFE RACING
3.1 A primary focus of Candy Store Cup racing is prudent seamanship and sailing in the safest possible manner. This regatta relies upon self-compliance and self-policing. Accordingly, participants are required to:
a) Ensure that the safety of the yacht, crew and guests is their primary consideration during the regatta;
b) Comply with the rules of the regatta;
c) Comply with all rules and regulations that apply to the yacht;
d) Have due regard to commercial shipping using Newport Harbor and its approaches;
e) Be courteous to all other participating yachts, the Organizer and its representatives, as well as all other vessels encountered on the racecourse;
f) Sign and submit a daily Declaration Form with the Organizer promptly after completion of each race specifying all safety related incidents and/or any breaches of the RRS and or the rules of the regatta.
3.2 If the Organizer receives corroborative or substantiated reports of a yacht being handled in an overly aggressive, un-seamanlike or unsafe manner, they may excuse the yacht from the regatta and/or declare the yacht, RRS Safety Afterguard member or racing tactician ineligible for future Candy Store Cup regattas.
4. RRS-SAFETY AFTERGUARD MEMBER COMPLIANCE
4.1 Each yacht shall ensure that that at least one afterguard member is active with The Racing Rules of Sailing (RRS) and has a thorough understanding of the RRS and the Appendix SY. The Captain or designated individual will submit the compliance form (page 2 of Exhibit 3) with information on the designated RRS-Safety Afterguard Member and the Communications Officer no later than June 15, 2017. Exhibit 3 can be found on the event website, and will be distributed to all captains via email. If the designated RRS Afterguard Member submitted a form at a previous regatta and the name is listed on the SYRA website superyra.org/after-guard then it is not required to resubmit the form.
4.2 The Organizing Authority will review all compliance forms prior to July 7, 2017 and communicate any concerns or issues to the Captain.
4.3 The Captain will designate a Communications Officer who will monitor and communicate on the VHF safety channel. It is recommended that this individual have experience with radio protocol and experience with and an understanding of the RRS and Appendix SY.
4.4 The Captain will determine what crew position the RRS-Safety Afterguard Member assumes (tactician, helmsman, navigator, strategist, etc.). The designated RRS-Safety Afterguard Member may assume the position of Communications Officer.
4.5 The RRS-Safety Afterguard Member shall attend all pre-race briefings and will be responsible for ensuring the Daily Declaration Form and portable GPS tracking unit are returned to the race office as soon as practicable following racing each day, but no later than two hours after finishing.
5.1 Yachts may be required to display advertising chosen and supplied by the Event Organizer.
5.2 Owners and their sponsors are responsible to inform advertisers that no activities advertising any brand will be permitted dockside ashore in Newport without the prior written consent of the Organizer.
6. ELIGIBILITY AND ENTRY
6.1 The Candy Store Cup is an invitational event open to sailing yachts over 90’ LOA, unless invited under the ‘Grandfather Clause.’
6.2 The entry deadline is June 15, 2017. A completed entry application and entry fee shall be received by The Candy Store Cup by the deadline. Entry acknowledgement will be sent to entrants shortly after entry receipt. The entry application can be found on the event website: www.CandyStoreCup.com
6.3 Entries may be accepted after the deadline at the sole discretion of the Organizer. A late fee of $500 will be assessed.
6.4 All yachts are required to have a current and valid ORCsy Rating Certificate. For a Handicap Application, application instructions, and a description of the ORCsy, visit www.ORC.org/superyacht. Any questions on handicapping or the rule should be directed to the ORC at: email@example.com or the Organizer. The yacht’s completed ORCsy handicap application must be submitted to ORC no later than June 23, 2017.
6.5 The Corinthian Spirit class is a non-spinnaker class (see Exhibit 4). A minimum of four (4) entry applications must be received by June 15 for the organizer to provide a class. All yachts in the Corinthian Spirit class are required to have a current and valid ORCcs handicap certificate (NOR 15). All yachts must submit their completed handicap application to the ORC no later than June 23, 2017 www.orc.org. The organizer and ORC will assist the Spirit class entrants with their handicap applications.
6.6 Each yacht is required to maintain the minimum level of insurance coverage as designated in NOR Part 1, paragraph 8. This requirement will be documented on the Disclaimer of Liability form, to be completed by each participating yacht at registration.
7.1 The entry application shall be accompanied by the entry fee. The entry fee is $4,500 for current SuperYacht Racing Association (SYRA) members under 100' and $5,600 for non-members. Fore yachts 110' and over, the entry fee is $6,500 for current SYRA members and $7,600 for non-members. For more information about SYRA and how to join visit: www.superyra.org. All organizers on the 2017 superyacht racing calendar are members of the SYRA and will offer differential entry fees given the important role that the SYRA plays in safety and fair racing.
7.2 Each entrant will be issued twenty (20) wristbands, which are required for each person participating in the Fleet Open House and the Candy Store Cup events. Passes for additional guests may be purchased in advance or at the Regatta Office.
7.3 The fee for obtaining a valid ‘ORCsy or ORCcs Rating Certificate’ (refer to NOR 6.4) is paid directly to the Rule Authority. The handicap application shall be submitted to the ORC no later than the June 23, 2017 deadline.
8. PRELIMINARY SCHEDULE OF EVENTS
8.1 Three races are scheduled, one for each day on Thursday, July 27, Friday, July 28 and Saturday, July 29.
8.2 See Exhibit 1 for the racing and shoreside schedule and details.
Registration for the Candy Store Cup will begin at 0900 on Wednesday, July 26. The following documents will be required at registration:
a) Acceptance of the Notice of Race and Sailing Instructions as set forth in the Entry Form;
b) Signed Disclaimer of Liability Form;
c) Crew list;
d) Name, mobile telephone number and email address of the yacht’s Captain, designated RRS-Safety Afterguard Member and Racing Tactician;
e) Valid ORCsy or ORCcs Certificate;
f) RRS-Safety Afterguard Member Resume / Credentials (NOR 4.1 – due to Organizer by July 7);
g) Confirmation on the number of extra crew / guest bracelets required.
The Event Organizer may, at its sole discretion, divide the fleet into classes based on the size, composition and attributes of the fleet. There may be a separate Corinthian Spirit class (NOR 6.5). A notice with the preliminary class breaks will be posted of the official website by July 15, 2017.
11 .SAILING INSTRUCTIONS
The Sailing Instructions will be posted on the event website and emailed to Captains on or before July 15, 2017 and will be available at the Race Office on-site. Yacht captains are encouraged to forward these documents to their owners, RRS-Safety Afterguard member and Racing Tactician in advance.
12. RACING AREA
The racing area for the Candy Store Cup will be Rhode Island Sound and Narragansett Bay.
13. THE COURSES
The courses will be coastal courses using inflatable and government buoys as marks of the course.
14. RACING FORMAT
14.1 It is the intent of the race committee to feature the traditional pursuit racing format. To enhance safe racing within the fleet, assigned start times may be adjusted, on a class basis, so that each class has a different projected finish time, i.e., those expected finish times will be separated by a “margin of safety”. This will result in less congestion at turning marks late in the race, particularly at the finishing line, and make the overtaking issue less onerous for the faster boats in fleet. Yachts will be assigned their own starting time for each race with slower rated yachts in each class starting first. The start time is determined by the yacht’s ToD handicap value and the race distance. The order in which the yachts finish in their specific class will determine the daily class results.
14.2 The race committee reserves the right to provide a conventional fleet racing or staggered start format for one or more performance oriented class depending on fleet composition.
15. HANDICAPPING AND SCORING
The ORCsy and ORCcs will be used for the 2017 Candy Store Cup.
16. PROTESTS AND RULES CLARIFICATION HEARINGS
16.1 The organizer takes a proactive stance on safe racing and good sportsmanship. Safe racing, rule compliance and rule enforcement is the responsibility of everyone involved in superyacht racing. This Notice of Race sends the implicit message that the focus is on safety and prudent seamanship, not competitive advantage. It reinforces the fact that the Candy Store Cup is a congenial racing event.
16.2 If there is an incident on the water and no protest is filed or penalty declared, the yachts’ RRS-Safety Afterguard members and Tacticians are expected to meet immediately following the racing to discuss and resolve any minor safety issues, sportsmanship, or issues pertaining to competitive advantage.
16.3 If unable to resolve an issue and/or agree on the yacht at fault, competitors may request a Rules Clarification Hearing with the Jury by checking the appropriate box on the daily Declaration Form.
16.4 Protest forms are available at the Race Office. Protests and requests for redress shall be delivered there within the protest time limit. Schedule of hearings will be posted on the Official Notice Board within 30 minutes of the protest time limit.
17. COMMUNICATIONS AND ELECTRONIC AIDS
17.1 A yacht shall not receive a radio transmission that is not available to all yachts. All types of electronic aids, including radar, VOR, satellite, are permitted. No external aids, outside assistance or information may be used during the races, except weather forecast information.
17.2 Yachts equipped with Automatic Identification System (AIS) are required to operate their AIS system from the time they approach the starting area until departing the finishing area following the race.
18.1 The safety of a yacht and its crew is the sole responsibility of the Captain who must ensure that the yacht is fully sound, thoroughly seaworthy and manned by an experienced and physically capable crew. Neither the establishment of regulations or inspection of a yacht in any way limits or reduces the complete and unlimited responsibility of the Captain.
18.2 It is the sole and inescapable responsibility of each yacht to decide whether or not to start or continue racing. See RRS 4, Decision to Race.
18.3 Competitors participate in the regatta entirely at their own risk. The Candy Store Cup, Newport Shipyard, the organizer, sponsors, and all other affiliated organizations and individuals of the 2017 Candy Store Cup do not accept liability for loss of life or injury to participants and others, or for the loss or damage to any vessel in any way or from any cause prior to, during or after the regatta.
19. TROPHIES AND PRIZES
19.1 Daily trophies for first place in class will be presented following the racing each day (at the Candy Store Cup Headquarters).
19.2 Series trophies for first, second and third place in each class will be presented at the awards ceremony on Saturday, July 29 (location to be determined).
19.3 The trophy to the Overall Winner of the Candy Store Cup will be awarded at the awards ceremony on Saturday, July 29.
19.4 There may be other special trophies awarded for meritorious acts, boat handling and other notable behaviour.
20. DISCLAIMER OF LIABILITY
20.1 The Candy Store Cup Disclaimer of Liability Form must be accurately completed and signed by the owner or charterer, Captain, crewmembers and guests of the yacht, and filed with the organizer prior to the first race of the regatta. The Disclaimer of Liability Form will be posted on the website by July 15, 2017.
20.2 In the event of any crewmember, guest or personnel change on board a yacht during the regatta, each new person shall sign the Disclaimer of Liability Form before participating in any race in the regatta.
21. AMENDMENTS TO THIS NOTICE OF RACE
The Organizer reserves the right to amend this Notice of Race. Any amendments will be posted on the event website.
